The Supreme Court heard oral argument in Azar v. Allina Health Services, a case concerning Medicare reimbursement payments to hospitals. The court was to decide the legality of the Health and Human Services Department’s (HHS) new formula for the Medicare Disproportionate Share Hospital (DSH) payments. These reimbursement payments mainly go to hospitals that treat low-income or uninsured patients. Allina Health Services, a group of non-profit hospitals, argued the new formula violates federal law because HHS did not undergo a notice and comment period. The new formula resulted in lower reimbursements for hospitals. Justice Brett Kavanaugh recused himself from this case because he heard the case while sitting on the D.C. Circuit Court of Appeals.

Justice Ruth Bader Ginsburg was absent from this oral argument, due to recovery from cancer surgery. close
