The Supreme Court heard oral argument in Hernandez v. Mesa, a case regarding constitutional protections beyond U.S. boundaries and whether the parents of a Mexican national can sue a border patrol officer for damages after that officer shot and killed their son in a 2010 cross-border incident. Fifteen-year-old Sergio Hernandez was playing with friends in a culvert that separates El Paso, Texas, and Mexico. An officer detained one of the friends on the U.S. side of the culvert, but Hernandez ran back to the Mexico side. The officer, still on the U.S. side, shot and killed Hernandez. The teen’s parents filed a lawsuit against several people including the officer, alleging that their son’s Fourth and Fifth Amendment rights were violated. The Court first heard oral argument in this case in 2017 and subsequently returned it to a lower court for additional consideration.
