The Supreme Court heard oral argument in United States v. Briggs, a consolidated case concerning whether there is a five-year statute of limitations for rape charges and convictions in the military. The case focuses on the rape convictions of three men who were in the military at the time of the crimes, charges, and prosecution. They argued they should not have been prosecuted because the Eighth Amendment bars the death penalty in cases that do not result in death, and there is therefore a statute of limitations that expired before any of them were convicted. The U.S. Court of Appeals for the Armed Forces ruled in favor of the military members. The federal government sought appeal at the Supreme Court, arguing there was no statute of limitations because Congress exempted military crimes that can be punished with the death penalty.

On December 10, 2020, the Court in an 8-0 decision reversed and remanded the case. close
