The Supreme Court heard oral argument in Carney v. Adams, concerning a Delaware constitutional provision requiring that appointments to the state’s major courts reflect a political balance. James Adams, a Delaware attorney who changed his party affiliation from Democratic to Independent, filed suit against a state law that only allows Democrats or Republicans to serve on the state’s highest appeals courts.

At the start of the proceedings, Chief Justice John Roberts paid tribute to the late Associate Justice Ruth Bader Ginsburg, who died on September 18, 2020.

The Court on December 10, 2020, ruled that Mr. Adams lacked a legal right to sue, known as standing, because he did not show that he was “able and ready” to apply for a judgeship on one of the Delaware courts. close
