The Supreme Court heard oral argument in Torres v. Madrid, a case concerning the Fourth Amendment and illegal seizure of a person. Roxanne Torres was driving under the influence of drugs and tried to evade police officers pursuing her. The officers fired shots, wounding Ms. Torres. She was taken to the hospital and later arrested. She filed suit, arguing the officers violated her Fourth Amendment rights against illegal search and seizure and excessive force. The Tenth Circuit Court of Appeals ruled in favor of the police officers, saying the shooting was not an illegal seizure because the shooting did not successfully stop her from moving. close
