At the center of the case was a 2003 federal law prohibiting federal aid to fight AIDS/HIV to private groups without policies opposing prostitution and sex trafficking, specifically Delaware-based Alliance for Open Society International. In 2013, the Court ruled that this requirement violated the First Amendment’s free speech and expression. After the ruling, USAID continued its enforcement of the anti-prostitution condition on the organization’s foreign entities.

Due to the coronavirus pandemic, the Supreme Court heard oral argument via teleconference on a case involving free speech and federal restrictions to AIDS and HIV funding to foreign affiliates of U.S.-based groups.
