The Supreme Court heard oral argument via teleconference in McGirt v. Oklahoma, a case concerning state versus federal criminal jurisdiction on Indian lands. Jimcy McGirt, a convicted sex offender in Oklahoma and a member of the Seminole Nation tribe, argued that the state in 1997 did not have jurisdiction to convict him of rape and other sex crimes on land believed to belong to the Creek Reservation. Under the Indian Major Crimes Act, any crime involving a Native American individual or victim that occurred on Indian land falls under federal jurisdiction. The justices were to rule on whether the crime indeed happened on Indian land, and whether Congress disestablished this land. The issue of whether the land was disestablished came before the Court in 2018, but the justices did not issue a ruling.
