Mnuchin, a consolidated case that questions the constitutionality of the structure of the Federal Housing Finance Agency (FHFA). The FHFA was created by Congress in response to the 2008 mortgage crisis to oversee Fannie Mae and Freddie Mac. The two companies then entered into an agreement with the Treasury Department to be propped up financially. That agreement was later amended to require Fannie Mae and Freddie Mac to pay the department dividends and fees. Private shareholders argued the companies overpaid and that the FHFA overstepped its authority. They also challenged restrictions that protect the agency’s director from being fired by the president without cause.
