The Supreme Court heard oral argument in Cedar Point Nursery v. Hassid, concerning the Fifth Amendment’s Takings Clause and union organizing. Under existing regulation, agriculture businesses are required to give unions access to work sites for purposes of organizing and talking to employees. Unions are supposed to give businesses notice and time before a visit. In addition, hours and number of visits are limited. This case dates back to 2015 when the United Farm Workers union tried unsuccessfully to gain access to Cedar Point Nursery and another business. Cedar Point Nursery and the union filed separate complaints with California’s Agriculture Labor Relations Board. Cedar Point Nursery also filed suit against the board, arguing the regulation to give unions access to their work sites amounts to an unjust and uncompensated taking of property. close
