The Supreme Court heard oral argument in Cedar Point Nursery v. Hassid, a case concerning the Fifth Amendment’s Takings Clause and union organizing. Under a California regulation, union organizers may enter the property of agricultural businesses to talk with employees about supporting a union. Unions are supposed to give businesses notice and time before a visit, and hours and number of visits are limited. In 2015, the United Farm Workers union tried unsuccessfully to gain access to Cedar Point Nursery and another business. Cedar Point Nursery and the union filed separate complaints with California’s Agriculture Labor Relations Board. Cedar Point Nursery also filed suit against the board, arguing the regulation to give unions access to their work sites amounts to an unjust and uncompensated taking of property.

The Court on June 23, 2021, ruled 6-3 that the California regulation is unconstitutional. close
