Strom, concerning Fourth Amendment rights and whether police may invoke the “community caretaking” exception to the warrant requirement when conducting a warrantless search of and seizure within a home. The case originated from an argument between Edward Caniglia and his wife, during which Mr. Caniglia grabbed his gun and told his wife to shoot him to put him out of his “misery.” Mrs. Caniglia eventually hid the gun and left the house. She later tried calling her husband without success, so she called the police. Officers found Mr. Caniglia physically okay, but the officers, knowing of the previous-night events, with the help of Mrs. Caniglia seized two guns and ammo. Mr. Caniglia tried unsuccessfully to get his guns back and filed suit.

The Supreme Court heard oral argument in Caniglia v.
