Caniglia v. Strom Oral Argument

The Supreme Court heard oral argument in Caniglia v. Strom, a case concerning Fourth Amendment rights and whether police may enter a home without a warrant and seize weapons of a person perceived to be endangering their life or the lives of others. The case originated from an argument between Edward Caniglia and his wife, during which Mr. Caniglia grabbed his gun and told his wife to shoot him to put him out of his “misery.” Mr. Caniglia eventually left the house, and Mrs. Caniglia hid the gun. The couple continued arguing when he returned home, and then Mrs. Caniglia left. The next morning she tried calling her husband without success, so she called the police. Officers found Mr. Caniglia physically okay, but he was taken to a hospital for evaluation. The officers, who knew about the previous-night events, with the help of Mrs. Caniglia seized two guns and ammo. After his release from the hospital, Mr. Caniglia tried unsuccessfully to get his guns back and filed suit. close
