Tsarnaev, a case concerning the Justice Department’s attempt to reinstate the Boston Marathon bomber’s death sentence. The attorney for the federal government argued to reimpose the death sentence for Dzhokhar Tsarnaev, who was convicted and sentenced to death for the April 2013 deadly bombings. He was the sole person convicted. His brother, Tamerlan, was also involved but was killed in a shootout with police during a manhunt after the bombings. The First Circuit threw out his death sentence for two reasons: One, they cited the trial judge erred because, during jury selection, potential jurors were not asked what they had heard or seen in the press about the case; and two, for not allowing Mr. Tsarnaev’s lawyers to use evidence concerning his brother. Mr. Tsarnaev’s legal team argued that by not allowing them to use this evidence, it weakened their case that his brother was the leader and sole influence on Mr. Tsarnaev.
