Fazaga, a case on whether the FBI may invoke state secrets privilege that allows the federal government to withhold information on national security grounds. The FBI in 2006-07 conducted its Operation Flex surveillance program in Southern California, claiming the program was aimed at identifying people recruiting or training others to commit acts of terrorism. The FBI infiltrated the Islamic Center of Irvine through an informant who gathered a variety of information, and told Muslim members he could engage in acts of violence and had access to weapons. Several members reported him to community leaders and to the Irvine police. Imam Yassir Fazaga and two congregants filed suit in 2011 against the FBI alleging they were targeted because of their religion. The court will decide whether a under a certain section of FISA, the FBI cannot assert this privilege and the case can move forward.
