The Supreme Court heard oral argument in Federal Election Commission v. Ted Cruz for Senate, concerning whether the Texas senator’s campaign can sue to challenge federal law for the repayment of personal loans and whether it violates his First Amendment rights to free speech. The 2002 Bipartisan Campaign Reform Act allows for a federal public office candidate for to borrow unlimited amounts from third parties or from themselves, but it limits the campaign from repaying the candidate’s personal loans with post-election contributions beyond a maximum of $250,000. One day before the 2018 election, Senator Cruz (R-TX) loaned his campaign $260,000 in order to establish the groundwork for a legal challenge. He and his campaign filed suit in April 2019 alleging the personal loan repayment limit violated the First Amendment. A federal district court agreed. The Federal Election Commission filed an appeal with the nation’s highest court and got an oral argument date. close
