The Supreme Court heard oral argument in Golan v. Saada, concerning international custody disputes involving children and the 1980 Hague Convention on the Civil Aspects of International Child Abduction. The child in this case was born in 2016 in Milan, Italy to an American mother, Narkis Golan, and an Italian father, Isacco Saada. In 2018, Ms Saada and the child traveled to the U.S. and never returned. Ms. Golan accused Mr. Saada of being abusive, threatening to kill her, and abusing her in front of the child. Mr. Saada filed suit in U.S. federal court to have the child returned to Italy based on international law. Under the Hague Convention, children taken from their country of residence must be returned in order for custody disputes to be resolved there, unless a child’s return is deemed a “grave risk of harm.”
