The Supreme Court heard oral argument in Torres v. Texas Dept. of Public Safety, concerning state sovereign immunity. Under the federal Uniformed Services Employment and Reemployment Rights Act of 1994, Leroy Torres, a military veteran, sued his state-agency employer for refusing to hire him for comparable job to that which he held before being called up from the reserves. The state of Texas argued that it has immunity from the suit because Mr. Torres' employer was a state agency. The justices were to decide whether Congress' constitutional war powers make states subject to lawsuits brought by individuals. close
