The Supreme Court heard oral argument in Biden v. Texas, a case stemming from the Biden administration’s attempt to end the Trump administration’s Migrant Protection Protocols program, which was implemented in 2019 and is informally known as the “Remain in Mexico” policy. Under MPP, noncitizens who cross via land routes at the U.S.-Mexico border are returned to Mexico to await their immigration proceedings. When President Biden took office in January 2021, the program was suspended and underwent a review. In June 2021, Homeland Security Secretary Alejandro Mayorkas ended the program. Two states, Missouri and Texas, filed suit arguing the program was unlawfully terminated. A federal district court ruled in favor of the states and ordered it to be reinstated. The Biden administration’s multiple appeals in the lower courts failed. On June 30, 2022, the Supreme Court ruled 5-4 against the Trump administration’s policy. close
