The Supreme Court heard oral argument in Merrill v. Milligan, a consolidated case on whether Alabama’s congressional redistricting map violates the Voting Rights Act (VRA). The focus is on Section 2 of the VRA that prohibits voting practices or procedures that discriminate on the basis of race. Following the 2020 Census, Alabama implemented in November 2021 a new map for seven congressional seats. District 7 historically has had a Black voter majority. Under the new 2021 map District 7 still has a high concentration of Black voters, but the remaining Black voters were divided among three other districts with majority white voters. Three federal lawsuits were filed alleging VRA violation. The judges in all three federal cases agreed the map likely violated Section 2 and ordered Alabama to redraw its map.
