The Supreme Court heard oral argument in Andy Warhol Foundation for the Arts v. Goldsmith, a copyright case concerning artist Andy Warhol’s use of photographer Lynn Goldsmith’s work in his 16 silkscreens of the musician Prince. In 2016, Condé Nast published the “Orange Prince” silkscreen after Prince’s overdose death. Ms. Goldsmith received no credit or monetary payment for this publishing, so she filed suit alleging copyright infringement. Mr. Warhol’s legal team argued his silkscreens, including the “Orange Prince,” were transformed as well as portrayed a different meaning and message than the original photo and is therefore allowed under the copyright law’s “Fair Use” doctrine that permits copyrighted work to be used if there was a major transformation from the original work. close
