The Supreme Court heard oral argument on Harvard’s race-conscious admissions policy. The case was originally part of a consolidated case and included the University of North Carolina, but it was separated after Justice Jackson joined the Court and recused herself due to her work on one of Harvard’s boards. Under Harvard policy, candidates' applications are read and numerically assessed by academic, extracurricular, athletic, and personal. Race is not considered in this step. In the overall rating, reviewers are allowed to give candidates “tips” for many things, including race, with competitive applicants then referred to subcommittee chairs for another round of ratings. Regional subcommittees meet to discuss which applicants to refer to the full admissions committee. The 40-member committee then determines its freshman class, and race is also among the many factors under consideration.
The Court later ruled that the policy violates the equal protection clause of the 14th Amendment. close
