The Justice Department was seeking to end this review and appointment altogether. The FBI executed a search warrant and seized the documents including classified ones, in August 2022. The Justice Department was investigating whether these White House documents were mishandled. This oral argument came as Attorney General Merrick Garland recently appointed a special counsel to oversee the Justice Department’s investigations involving the former president.
