Texas, a case on whether the Biden administration’s policy to prioritize certain non-citizens for detention and removal from the U.S. is illegal. In 2021, the Department of Homeland Security Department set enforcement priorities for three categories of non-citizens. Non-citizens who are threats to national security, public safety or border security are targeted for detention and removal. Texas, a border state with Mexico and Louisiana, filed suit alleging the policy violates federal immigration law. DHS said it was forced to set these priorities because it did not have the resources to detain and remove all of the millions of non-citizens in the U.S.

The Supreme Court heard oral argument in United States v. Texas, a case on whether the Biden administration’s policy to prioritize certain non-citizens for detention and removal from the U.S. is illegal.
