The Supreme Court heard oral argument in Department of Education v. Brown, involving two student loan borrowers who did not qualify for maximum forgiveness for President Biden’s student loan debt relief program that Education Secretary Miguel Cardona adopted in August 2022. The two borrowers filed suit, arguing the program is unlawful. The administration argued the secretary had legal authority to enact the program under the Higher Education Relief Opportunities for Students Act (HEROES), which gives the education secretary authority to “waive or modify” federal student loan programs to ensure borrowers experiencing economic burdens from a national emergency declaration (in this case the COVID-19 pandemic) are not financially worse off due to their loans. A federal district court ruled in favor of the borrowers and issued a nationwide injunction preventing the program from taking effect. The U.S. Court of Appeals for the Fifth Circuit denied the Biden administration a stay. close
