The Supreme Court heard oral argument in Biden v. Nebraska, a case involving six states challenging the legality of President Biden’s student loan debt relief program that was approved and adopted in August 2022 by Education Secretary Miguel Cardona. The administration argued the secretary had legal authority to enact the program under the Higher Education Relief Opportunities for Students Act (HEROES), which gives the education secretary authority to “waive or modify” federal student loan programs to ensure borrowers experiencing economic burdens from a national emergency declaration (in this case the COVID-19 pandemic) are not financially worse off due to their loans. Nebraska and five other states argued that the program is not lawful. At the federal district court level this case was dismissed for lack of standing.
