The Supreme Court heard oral argument in Tyler v. Hennepin County, a case on the Fifth Amendment’s takings clause. A Minnesota County in 2016 sold resident Geraldine Tyler’s condo for $40,000 after she failed to pay her taxes for several years. The county kept the taxes owed as well as the amount left over. Ms. Tyler sued, arguing that the sale violated the takings clause, the Eighth Amendment’s excessive fines clause, and substantive due process.
The Court later ruled unanimously that Hennepin County violated the takings clause. close
