Cases discussed The reasons behind the Court’s delay in handing down a decision in Webster v. Reproductive Health Services are discussed along with predictions as to what the decision will be. Two death penalty cases are analyzed. Penry v. Lynaugh was a case questioning the right of a state to execute a mentally retarded murderer. The Court upheld the right of Texas to execute the mentally retarded. Stanford v. Kentucky challenged the right of the state of Kentucky to execute a person who committed a murder while a juvenile. The Court upheld the Kentucky law. In Browning-Ferris Industries v. Kelco Disposal, Inc., Browning-Ferris contested a punitive damage award of 6 million dollars to Kelco on the Eighth Amendment grounds of protection from excessive fines. The Court ruled in favor of Kelco, saying that the Eighth amendment does not cover civil suits . close
