The Supreme Court considered how the Environmental Protection Agency should hold states accountable for air pollution that drifts into neighboring states under the Clean Air Act. The Court heard oral argument on December 10 in two combined cases - the EPA v. EME Homer City Generation and the American Lung Association v. EME Homer City Generation. Last year, a lower court struck down a part of that law that set emission standards for 28 states based on the air quality of states downwind, saying the EPA overstepped its legal authority with the regulations. close
