The issue in this case is California Proposition 140 which puts a lifetime ban on state legislative service. Mr. Bates is a member of the California Assembly who initiated the suit and Mr. Jones was a sponsor of the bill. The California Supreme Court upheld the law in 1991. A three-judge panel from this circuit heard the appeal of this case from the decision handed down by a federal judge declaring the law unconstitutional. close
