Senator Feinstein on a judicial nominee's religion If someone who wants to be a judge thinks that her religious beliefs should trump her oath of office, is it fair for those who vet the judge to ask her about that belief? To hear some tell it, religion is off limits because our Constitution prohibits religious tests for public office. And it does, but it also requires that judges swear an oath to uphold that Constitution. As several brave and constitutionally literate politicians have said, “I put my hand on the Bible and swore to uphold the Constitution. I didn’t put my hand on the Constitution and swear to uphold the Bible.” close
