The Supreme Court heard oral argument in Army Corps of Engineers v. Hawkes, docket number 15-290, which concerns whether a landowner can challenge the government’s determination that a property contains protected wetlands.The dispute arose from a proposed peat-mining operation in Minnesota. Hawkes Company was fighting a decision by the U.S. Corps of Engineers for deciding the property in question contains wetlands that fall under the Clean Water Act. The question before the Supreme Court was whether the decision could be challenged immediately or must wait for a permit, which could take years.

On May 31, 2016, the court unanimously ruled that a property containing “waters of the United States” can be challenged immediately in court. close
