Sessions v. Morales-Santana Oral Argument
Luis Ramon Morales-Santana was born in the Dominican Republic to an unmarried American father and Dominican mother. He challenged his deportation and won arguing that the gender distinction for men and women for birthright citizenship as unconstitutional. The Supreme Court was reviewing if the law violated the Fifth Amendment’s guarantee of equal protection and whether the Second Circuit Court of Appeals had the authority to confer U.S. citizenship on the respondent.
On June 12 the court ruled that the law violates the Fifth Amendment’s requirement that all people must be treated equally under the law.
The case was originally called Lynch v. Morales-Santana.
