Wesby, a case concerning the Fourth Amendment and probable cause arrests. Theodore Wesby was one of several people initially arrested for unlawful entry after attending a party at a home in the Washington, D.C., Anacostia neighborhood. Police argued the home was vacant. Twenty-one people were arrested. Mr. Wesby and 15 others filed suit claiming unlawful arrest. The Supreme Court was to decide two issues: 1) whether officers violated the partygoers Fourth Amendment rights by arresting them without probable cause, and 2) whether officers were covered under qualified immunity, thereby protecting them from being held liable for damages in civil proceedings.
On January 22, 2018, the Court ruled unanimously that the officers 1) had probable cause to arrest the partygoers, and 2) that the officers were entitled to qualified immunity.
