The Supreme Court heard oral argument in O’Connor-Ratcliff v. Garnier, concerning public officials who use social media to communicate with the public and whether they can block people from their pages. Michelle O’Connor-Ratcliffe and T.J. Zane are school board members with the Poway Unified School District (PUSD) in San Diego. After their election, they each created new Facebook accounts for their positions. On these, constituents could comment or react to postings with emojis. Christopher Garnier and his wife, parents of children in the PUSD, posted lengthy and at times repetitive comments on their accounts. The school board members began deleting or hiding some posts. Later, they also blocked the Garniers, who filed a suit alleging their First Amendment rights were violated. They won at both the district court and the U.S. Court of Appeals for the Ninth Circuit. close
