Cases discussed: McNamara v. County of San Diego (See Supreme Court Review 12/13/88). Browning-Ferris Industries v. Kelco Disposal is an anti-trust suit which involves a punitive damage award. Compensation for punitive damage is an award which excedes actual damages. The defense argues that punitive damage awards in civil cases are a breech of the Eighth Amendment’s guarantee of protection from "cruel and unusual punishment". Pittston Coal Group v. Sebben concerns Black Lung Disease treatment benefits for workers. The implications of the Court’s decision, which favor the coal company, are considered. A California sobriety case that the Court refused to review is analyzed. Also, a West Virginia tax case that involves disparity in property taxation is also discussed. close
