Justices Ruth Bader Ginsburg, Stephen Breyer and Sonia Sotomayor formed the court's dissent. The Court heard oral argument for Kahler v. Kansas, a case challenging the constitutionality of a state statute that eliminates the insanity defense. James Kahler was convicted of killing his wife, two teen daughters and his mother-in-law. His attorney argued that he was not in the right mental state for some time after his wife had an affair with another woman, left him, took the kids and filed for divorce. A jury found him guilty and sentenced him to death. Under Kansas law, a defendant can get the death penalty even if that defendant has a mental disorder that prevents him/her from knowing what he/she did.
