The Supreme Court heard oral argument in Bucklew v. Precythe. The case concerns whether Missouri’s lethal injection protocol is cruel and unusual punishment for death row inmate Russell Bucklew, who has a rare medical condition, cavernous hemangioma. He was sentenced to death for the 1995 murder of a man who was housing his ex-girlfriend and her children. His lawyers challenged his execution, arguing that a lethal injection would cause him intense pain, suffocation and prolonged agony, due to his condition. Mr. Bucklew’s legal team recommended he be executed via gas chamber because that method would be a faster death.

The Court on April 1, 2019, rules 5-4 to move forward with the execution. Justice Gorsuch in writing the majority opinion said, “The Eight Amendment forbids ‘cruel and unusual’ methods of capital punishment but does not guarantee a prisoner a painless death.” close
