The Supreme Court heard oral argument in McCrory v. Harris, a racial gerrymandering case concerning two North Carolina congressional districts. Black voters in those districts sued, arguing that the Republican-led legislature packed minorities into Districts 1 and 12, diminishing their vote in other parts of the state. The 14th Amendment’s Equal Protection Clause prohibits the government from using race as a “predominant” factor in redistricting unless it serves a compelling state interest.
