The Supreme Court heard oral argument in Terry v. United States, a case on whether defendants who received greater sentences for low level crack cocaine offenses can get sentencing relief under the new 2018 First Step Act. Tarahrick Terry was convicted in 2008 for possession with intent to distribute 3.9 grams of crack cocaine and sentenced to 188 months. At the time, sentencing was governed by a three-tier structure. Mr. Terry fell under tier three, and under it he would not face more than a 20-year prison sentence. Tiers one and two had more severe sentencing, including the potential for a life sentence for offenders with possession of five to 50 grams or more of crack cocaine. These sentencing guidelines were widely criticized for their disparity in crack versus powder cocaine and the amount of possession.
