The Supreme Court heard oral argument in United States v. Zubaydah, which involves the state secrets privilege and the detention and torture at various CIA “black sites” of an accused al-Qaida operative held at Guantanamo Bay since 2006. Under the state secrets privilege, the federal government can restrict access to information and legal proceedings if it is believed that disclosure is a threat to national security. Abu Zubaydah was picked up by Pakistani officials working with the CIA, accused of being a high-ranking al-Qaida member, and subjected to torture at various CIA “black sites.” His attorney filed a criminal complaint in Poland, seeking to hold accountable Polish nationals who worked with the CIA, but an investigation into the matter was closed. The attorney then filed with the European Court of Human Rights, which ruled in his favor. Poland reopened the investigation, but the U.S. refused to provide certain information and documents, asserting the state secrets privilege. close
