The Supreme Court heard oral argument in Berger v. North Carolina State Conference of the NAACP, a case on civil procedure and whether state lawmakers can intervene in a lawsuit to defend a voter identification law. Democratic Governor Roy Cooper vetoed the law, but the Republican-controlled North Carolina legislature overrode it. Several lawsuits challenging the law resulted, including one by the North Carolina State Conference of the NAACP. Senate President Pro Tempore Phil Berger (R) and Speaker of the House Timothy Moore (R) tried to become defendants in the lawsuit. Under civil procedure rules, a person may intervene in a lawsuit if there is no proper representation by the parties involved in the suit. The state legislators that argued the Democratic attorney general is not representing their views or the law adequately in court. close
