America and the Courts featured a highlight of continuing discussion in the United States Senate on the nomination of Miguel Estrada for the U.S. Court of Appeals for the DC Circuit. Senators Robert Bennett and Dick Durbin presented the arguments of the two sides.

This week, Senate Democrats began delaying Mr. Estrada’s confirmation vote on the Senate floor. Democrats wanted more information on Mr. Estrada’s legal views, including memoranda he wrote at the Department of Justice. On Thursday, Republican White House counsel Alberto Gonzales refused permission to provide these documents, citing attorney-client privilege. After the Senate’s President’s Day recess, debate was scheduled to continue on Mr. Estrada’s nomination on February 24, 2003. close
