Supreme Court Hears Case Challenging Abortion Pill Access
1 hour, 34 minutesThe Supreme Court heard its first abortion access case since overturning Roe in 2022. They heard oral argument in FDA v. Alliance for Hippocratic Medicine (AHM), a consolidated case challenging the FDA's approval for expanded use for the abortion pill mifepristone. The medication, approved by the FDA in 2000, is part of a two-pill regimen for terminating early pregnancies. In 2016 the FDA expanded the drug's use from seven to 10 weeks of pregnancy, reduced the number of in-clinic appointments needed and gave prescribing authority to health care providers who are not physicians. In 2021 the agency removed the in-person requirement altogether. This case dates to 2023 and was first heard in a federal district court in Texas, where that judge halted the FDA's approval of the medication. On appeal, a three-judge Fifth Circuit panel then ruled only against the FDA's expanded access criteria for the drug. The nation's highest court now has through June 2024 to issue a ruling in this case.
